American Oversight Welcomes Supreme Court Decision Protecting Ballot Access
Court upholds states' ability to count lawfully cast mail ballots amid continued attacks on free and fair elections
In response to Monday’s Supreme Court decision in Watson v. RNC upholding states’ ability to count ballots mailed on or before Election Day and received afterward, American Oversight released the following statement welcoming the ruling as a victory for voters and election administrators while warning that efforts to undermine free and fair elections remain ongoing:

“Today’s decision is a victory for voters, election administrators, and the basic principle that eligible Americans should have their votes counted. The Court properly reaffirmed that states have the authority to ensure that lawfully cast ballots are not discarded because of circumstances beyond a voter’s control. But this ruling comes amid a broader assault on our elections — one marked by confusion, barriers to voting, and relentless efforts to weaken public confidence in free and fair elections. Protecting our democracy requires constant vigilance, transparency, and real accountability for those who seek to undermine it.”
The Watson case arose from a challenge brought by the Republican National Committee and Mississippi Republicans seeking to invalidate a longstanding Mississippi law — like those found in a number of other states — that ensured voters who cast their ballots on time are not disenfranchised because of mail delays outside their control. By upholding that law, the Court preserved states’ longstanding authority to protect eligible voters while providing election officials with clear rules for administering elections.
The decision arrives amid a series of recent rulings that have narrowed voting rights protections and made it more difficult to challenge voting restrictions in court.
